These Terms of Service ("Terms") govern your access to and use of the RQ200 property-management platform ("Service"), operated by RQ200 ("we", "us", or "our").
By creating an account, clicking "I agree," or otherwise using the Service, you ("Customer", "you") agree to be bound by these Terms. If you are agreeing on behalf of an organization, you represent that you have authority to bind that organization and the word "you" refers to that organization.
If you do not agree to these Terms, do not use the Service.
RQ200 is a multi-tenant web application that helps property owners and managers track buildings, maintenance tasks, jobs, contractors, units, and tenants. Core capabilities include: role-based access for admins, managers, contractors, and brokers; task and job tracking with photo/video documentation; map views; email and in-app notifications; a tenant request portal; rental application processing; and secure cloud-based media storage.
The Service is provided over the internet and accessed through a web browser or installed progressive web app (PWA). No software installation on your servers is required.

We may suspend or terminate accounts where we have reason to believe credentials have been compromised or the account is being used in violation of these Terms.
You agree to use the Service only for lawful purposes and in a manner consistent with these Terms. Specifically, you agree not to:
You represent and warrant that you have the legal right and authority to upload and process all data you place in the Service, including all tenant and applicant personal information. You are solely responsible for compliance with applicable privacy, fair housing, and consumer-reporting laws with respect to data you collect and submit.
You own your data. All content you or your sub-users create or upload through the Service — buildings, tasks, jobs, tenant records, media files, notes, and any other data ("Customer Data") — remains your property. RQ200 does not claim ownership over Customer Data.
You grant RQ200 a limited, non-exclusive, royalty-free license to store, process, display, and transmit Customer Data solely as necessary to operate and improve the Service for your benefit. We do not use Customer Data for advertising, do not sell it, and do not share it except as described in our Privacy Policy.
RQ200 is a data processor. Where applicable law distinguishes between data controllers and data processors, your organization acts as the data controller for the personal information of tenants and applicants you manage; RQ200 acts as a data processor, processing that data on your instructions.
You are responsible for obtaining any consents required by law before entering personal information about third parties (tenants, applicants) into the Service.
RQ200 owns all rights, title, and interest in and to the Service, including the software, user interface, design, algorithms, and all underlying technology. Nothing in these Terms transfers any intellectual property rights in the Service to you.
You may not copy, modify, create derivative works of, distribute, or publicly display any part of the Service without our prior written consent, except as expressly permitted by these Terms.
We welcome feedback about the Service. Any feedback, suggestions, or ideas you provide to us may be used by us without restriction or compensation to you.
Important: RQ200 is in active development (heavy beta). We are continuously building and improving the platform. Features may change, be added, or be removed. We will do our best to provide advance notice of breaking changes, but we cannot guarantee it at this stage.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, RQ200 DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or free from security vulnerabilities. We do not warrant that data stored in the Service will never be lost or corrupted — you should maintain your own backups of critical data.
This disclaimer does not affect any rights you may have that cannot be waived under applicable law.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, RQ200 AND ITS OPERATORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
RQ200's total cumulative liability to you for any claims arising out of or related to these Terms or the Service shall not exceed the greater of: (a) the total fees you paid to RQ200 in the twelve (12) months immediately preceding the claim; or (b) $50 USD (a nominal floor while the Service is provided free of charge).
Some jurisdictions do not allow the exclusion or limitation of certain damages. If those laws apply to you, some or all of the above exclusions or limitations may not apply, and you may have additional rights.
You agree to indemnify, defend, and hold harmless RQ200 and its operators, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:
These Terms take effect when you create an account and remain in effect until terminated.
You may terminate your account at any time by contacting us at support@rq200.com. We will close your account and cease billing (once billing is active).
We may suspend or terminate your access if you violate these Terms, fail to pay fees when due, or if we discontinue the Service, with reasonable notice where practicable.
Data export and deletion: Upon termination (whether initiated by you or us), you may request an export of your Customer Data within 30 days of termination. We will provide a machine-readable export of your data upon request sent to support@rq200.com. After 30 days post-termination, we may delete your Customer Data from our systems. We will retain data as required by applicable law.
Sections 5 (Customer Data), 6 (IP), 7 (Disclaimer), 8 (Liability), 9 (Indemnification), 12 (Governing Law), and 13 (Contact) survive termination.
We may update these Terms from time to time as the Service evolves. When we make material changes, we will update the "Last updated" date at the top of this page and notify you by email (to the address on your account) or by a notice within the Service, at least 7 days before the changes take effect where practicable.
Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of those Terms. If you do not agree to the revised Terms, you should stop using the Service and request account closure.
For minor clarifications or non-material changes, we may update the Terms without specific notice. We encourage you to review this page periodically.
These Terms and any dispute arising out of or related to them or the Service shall be governed by the laws of the State of New York, without regard to its conflict-of-law provisions.
You agree that any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in New York County, New York, and you consent to the personal jurisdiction of those courts.
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
